Section 01Acceptance of these terms
These terms form an agreement between you and Venaera Inc., a company incorporated in the United States with its principal place of business in Chatsworth, California. By accessing or using getvenaera.net, you agree to these terms. If you do not agree with them, do not use the site.
If you access this site on behalf of an organization, you confirm that you have authority to accept these terms on its behalf, and references to you include that organization.
Website and services
This website describes Venaera's managed detection and response service. It does not itself provide that service, and using the site does not create a client relationship.
Security services are provided only under a separate written agreement signed by both parties, which sets out scope, coverage, service commitments, data handling, fees, and term. Where any provision of that agreement conflicts with these terms, the agreement governs for the services it covers. Nothing on this website modifies a signed agreement or creates an obligation to provide services.
No statement on this website constitutes an offer capable of acceptance. Engagements are scoped and priced individually, and submitting a briefing request does not oblige either party to proceed.
Permitted use
You may access and view this site for your own business evaluation and informational purposes. You may print or save individual pages for internal reference within your organization, provided you do not remove attribution or alter the content.
Any other use requires our prior written permission, including redistribution, republication, commercial reuse, or incorporation of this site's content into another product or service.
Prohibited conduct
You agree not to do any of the following in connection with this site.
- Attempt to gain unauthorized access to the site, its hosting infrastructure, or any connected system.
- Probe, scan, or test the vulnerability of the site or its infrastructure without our prior written authorization, including automated scanning.
- Interfere with the availability or integrity of the site, including through denial of service activity or deliberate overload.
- Scrape, harvest, or systematically extract content, or use automated means to access the site in a manner that imposes an unreasonable load.
- Misrepresent your identity or affiliation, or impersonate Venaera or any Venaera personnel.
- Use the site or its content in any way that is unlawful, fraudulent, or infringes the rights of others.
We take security testing seriously and welcome coordinated disclosure. If you believe you have found a vulnerability in our website or systems, email contact@getvenaera.net before taking any further action, and we will work with you in good faith.
Intellectual property
This site and its contents, including text, layout, design, graphics, source code, and the Venaera name and logo, are owned by Venaera Inc. or used under licence, and are protected by copyright, trademark, and other intellectual property laws.
Except for the limited permitted use described above, no licence or right is granted to you by implication, estoppel, or otherwise. Any third party marks referred to on this site remain the property of their respective owners, and reference to them does not imply endorsement, affiliation, or partnership in either direction.
Informational nature of content
Content on this site is provided for general information about our service. It is not security advice, legal advice, regulatory guidance, or a recommendation for your specific environment, and it should not be relied on as the basis for a security or compliance decision.
Security requirements depend on facts particular to each organization. Nothing here establishes that a described capability is suitable for your estate, satisfies an obligation that applies to you, or will produce a particular result. For advice specific to your circumstances, engage us or another qualified adviser under an appropriate agreement.
Service and performance statements
Figures and descriptions of service behaviour on this site, including triage timings, coverage characteristics, and response targets, describe how the service is designed to operate and the targets we work to. They are illustrative of our standard practice and are not contractual commitments.
Binding service commitments exist only where they are stated in a signed client agreement, where they are defined precisely and measured against agreed criteria. Any screens, consoles, metrics, or case details shown on this site are representative illustrations of the platform's output and do not depict a real client environment or a real security incident.
Forward looking statements about our roadmap or intentions reflect current expectations and may change without notice.
Enquiries and submissions
When you contact us, including through the briefing request form, you are responsible for ensuring you have the right to share the information you provide and that it is accurate. Please do not send us confidential technical detail, credentials, live incident data, or sensitive personal information through an unprotected channel. If an engagement requires that material, we will agree a protected method for exchanging it.
Information you send us is handled in accordance with our privacy policy. If you send us a suggestion or idea about our service without a written confidentiality agreement in place, we may use it without obligation or compensation, and we will not treat it as confidential.
Availability and changes
We may modify, suspend, or discontinue any part of this site at any time without notice, and we may change its content, structure, or these terms. The effective date at the top of this page indicates when the current version took effect, and continued use after a change constitutes acceptance of the updated terms.
We do not guarantee that the site will be uninterrupted, timely, error free, or free of harmful components, although we make reasonable efforts on all of those fronts.
Disclaimer of warranties
This site and its content are provided on an as is and as available basis. To the fullest extent permitted by law, Venaera disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non infringement.
We do not warrant that the content of this site is complete, current, or free from error, or that it will meet your requirements. This section does not limit any warranty expressly given in a signed client agreement, and it does not exclude any warranty that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Venaera and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of this site, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability arising out of or related to your use of this site will not exceed one hundred United States dollars. Liability arising under a signed client agreement is governed by the limitation provisions of that agreement rather than this section.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions or limitations, in which case the provisions above apply to the maximum extent permitted and the remainder stays in force.
Indemnification
You agree to indemnify and hold harmless Venaera Inc. and its officers, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of this site, or your violation of applicable law or the rights of a third party in connection with the site.
Governing law and disputes
These terms and any dispute arising out of or relating to them or to this site are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and Venaera agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any dispute that is not resolved informally, and each party waives any objection to venue in those courts. Before commencing proceedings, the parties will attempt in good faith to resolve the dispute by raising it in writing and allowing thirty days for a response.
This section concerns disputes about this website and these terms. Dispute resolution for service engagements is governed by the relevant client agreement.
General provisions
These terms, together with our privacy policy, constitute the entire agreement between you and Venaera regarding this website, and supersede any prior understanding on that subject. They do not supersede a signed client agreement.
If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these terms without our written consent, and we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these terms creates a partnership, agency, joint venture, or employment relationship between you and Venaera.
Neither party is liable for failure or delay in performance caused by events beyond its reasonable control. These terms are drafted in English, and any translation is provided for convenience only.
